1. INTRODUCTION

These Terms govern your access to and use of our Website (goautomate.io) and Community Forum (community.goautomate.io) (together called the "Sites"). The Sites are operated by Workflow Science Limited trading as GoAutomate ("we", "us", "our"), a company registered in England and Wales with a registered offices at 29 Wood Street, Stratford-Upon-Avon, Warwickshire, CV37 6JG, England.

By accessing or using the Sites, you accept these Terms of Use and agree to comply with them. If you disagree with these Terms of Use, please do not use the Sites. These Terms of Use should be read alongside our Privacy Policy, Cookie Policy and, if you are a user of one of our Applications, our Terms of Service.

2. DEFINITIONS

"Content" - Text, images, video, audio, data, or other materials.
"Community Forum" - Interactive features allowing Users to post Content available at community.goautomate.io.
"Intellectual Property Rights" - means patents, rights to inventions, copyright and related rights, trademarks, trade names and domain names, rights in get-up, rights in goodwill or to sue for passing off, rights in designs, rights in computer software, database rights, rights in confidential information (including know-how and trade secrets) and any other intellectual property rights, in each case whether registered or unregistered and including all applications (and rights to apply) for, and renewals or extensions of, such rights and all similar or equivalent rights or forms of protection which subsist or will subsist now or in the future in any part of the world.

"User Content" - means any Content that a User posts, uploads, publishes, submits, or transmits to be made available through the Community Forum.

3. SITE ACCESS

We provide access to the Sites on a temporary basis and may withdraw or change our service without notice. We are not liable if the Sites are unavailable.

You are responsible for maintaining the confidentiality of your information and must notify us of any unauthorised access or use.

We reserve the right to modify or discontinue any part of the Sites at any time without notice or liability.

4. COMMUNITY FORUM RULES

4.1 Acceptable Use

You may only use our Community Forum for lawful purposes and in accordance with our Acceptable Community Conduct Policy. Prohibited uses include:

  • Breaching any laws or regulations;

  • Posting fraudulent or unlawful content;

  • Sending spam; and/or

  • Transmitting viruses or harmful code.

4.2 User Conduct

You must not:

  • Post offensive, defamatory, or discriminatory content;

  • Infringe others' intellectual property rights;

  • Impersonate others; or

  • Interfere with others' use of the Forum.

4.3 Reporting and Enforcement

Please report all inappropriate Content or User Content via goautomate.io/contact/policy.

We may remove content, disclose user information to third parties claiming rights violations, take legal action, or terminate access to the Sites at our discretion.

4.4 Disclaimer Regarding User Content

We do not control, endorse, or take responsibility for any User Content submitted by users to the Community Forum. We are not responsible or liable to any third party for the content or accuracy of any User Content posted by you or any other user of the Community Forum.

4.5 Monitoring and Enforcement

We have the right to:

  • Remove or refuse to post any User Content for any or no reason;

  • Take any action with respect to any User Content that we deem necessary or appropriate in our sole discretion;

  • Disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, including their Intellectual Property Rights or their right to privacy;

  • Take appropriate legal action, including without limitation, referral to law enforcement, for any illegal or unauthorised use of the Site; and/or

  • Terminate or suspend your access to all or part of the Site for any violation of these Terms of Use.

5. INTELLECTUAL PROPERTY

5.1 Our Intellectual Property

The Sites and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by us, our licensors, or other providers of such material and are protected by United Kingdom and international copyright, trademark, patent, trade secret, and other Intellectual Property Rights laws. In particular, we have trademarks in respect of certain names, logos and slogans which you may not use in any other context without our prior written permission.

5.2 User Content Ownership

You retain any and all of your rights to any User Content you submit, post, or display on or through the Community Forum and you are responsible for protecting those rights. We take no responsibility and assume no liability for User Content you or any third party posts on or through the Community Forum.

5.3 Licence to User Content

By posting User Content on or through the Community Forum, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such User Content in any and all media or distribution methods now known or later developed. This license authorises us to make your User Content available to the rest of the world and to let others do the same. You agree that this license includes the right for us to provide, promote, and improve the Sites and to make User Content submitted to or through the Sites available to other companies, organisations or individuals for the syndication, broadcast, distribution, promotion, or publication of such User Content on other media and services, subject to our terms and conditions for such User Content use.

Our Privacy Policy governs how we collect and use your data. We comply with GDPR and UK data protection laws.

7. DISCLAIMERS AND LIABILITY

7.1 No Warranties

8. TERMINATION

We may terminate your access without notice if you violate, or if we acting reasonably determine that you have or may violate, these Terms of Use or the Acceptable Community Conduct Policy. Upon termination:

  • Your right to use the Sites ceases;

  • Your account may be disabled or deleted and you may be prevented from accessing any stored files or other information as part of your account; and

  • Certain provisions of these Terms will continue to apply including those terms around ownership, warranty disclaimers, limitation of liability etc.

9. GOVERNING LAW

These Terms are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction over any disputes.

10. AMENDMENTS

We may update these Terms at any time. Changes are effective immediately upon posting on the Website. Your continued use of the Sites after posting such changes constitutes acceptance of any changes.
